These Terms of Service set out the rules that govern the use of the website and the phone intake counter operated by PeakScreen Mobile Testing LLC. They cover device screening, battery and port checks, screen grading, trade-in condition reports, fleet device audits and data wipe verification certificates. They also cover the website itself, including the contact form and the pages that describe our services. Please read them before you leave a device with the counter team or rely on a report we issue.

By using the website, booking an intake appointment, or leaving a device at the counter, you agree to these terms. If you do not agree, please do not use the website and do not leave a device with us. If you are agreeing on behalf of a business, you confirm that you are authorised to accept these terms for that business.

Acceptance of These Terms

These terms form a binding agreement between you and PeakScreen Mobile Testing LLC. They apply from the moment you first use the website or bring a device to the counter, and they continue to apply to any report, certificate or record we issue and to any later question about that record.

The terms work together with our Privacy Policy, which explains how we handle information. Where a business client has signed a separate written agreement with us, that agreement controls to the extent it conflicts with these terms. In all other cases, these terms and the Privacy Policy together describe the whole agreement between us.

If any part of these terms is found to be unenforceable, the rest remains in force, and the unenforceable part is replaced by a provision that comes as close as possible to the original intent.

Services We Provide

We operate a phone intake counter. Our services include walk-in phone screening and diagnostics, battery and charging port checks, screen and touch response grading, trade-in condition reports, business fleet device audits, and data wipe verification certificates.

Each service is performed at the bench against a written test card. That means the same steps are walked every time, and the result is recorded rather than remembered. We do not sell devices, we do not operate as a repair workshop, and we do not guarantee that a device can be improved. What we provide is an assessment and a record of condition and performance at the time of the visit.

We may decline a service where a device cannot be handled safely, where a request falls outside what our test cards cover, where the work would require opening private content, or where accepting the device would place the counter or its records at risk. We may also discontinue a service or change how it is performed, and we will describe any material change on the website.

Eligibility and Authority

You must be old enough to enter a binding agreement in your location to use the counter service, and you must have the legal right to leave the device with us. If you bring a device that belongs to someone else, you confirm that you have that person permission to submit it for screening, to receive the findings, and, where relevant, to authorise a wipe verification.

If you act for a business, you confirm that you are authorised to agree to these terms on the business behalf and to instruct us on device handling, audit scope and report delivery. We may ask for evidence of authority where the circumstances make it appropriate.

We may refuse service where we have a reasonable belief that a device is stolen, that a request is unlawful, or that the person presenting the device is not entitled to do so.

Intake and Drop-off Process

Every visit begins with an intake slip. The slip records the device identity, the service requested, any concern you want checked, and a contact method for reaching you. The slip is the anchor for the visit, and the report we later issue will refer back to it.

Once the slip is completed, a technician seats the device in a cradle bay and works the relevant test card. Most single-device screenings finish in one sitting. Where a task takes longer, the device is stored at the counter and you are told when to expect the result. A device is released only against the same intake slip or against another record you have arranged with the team.

You are responsible for telling us at intake about any matter that could affect safe handling, such as a swollen battery, a cracked enclosure or liquid exposure. A swollen battery in particular is a safety matter, and we may handle or decline such a device differently from a standard screening.

Customer Duties

You agree to provide accurate information about the device and the service you want. You agree to remove or disable anything that would prevent the requested work from being completed, such as a lock that blocks a diagnostic you have asked us to run. If you ask us to run a step that needs an unlocked device, you agree to unlock it or arrange the access the step requires.

You agree to collect the device within the period told to you at intake, and to keep your contact details current so we can reach you about the visit. You agree to raise any concern about a finding promptly, so that a question about a grade or a measurement can be answered from the same record while it is fresh.

You agree not to use the counter service or the website for any unlawful purpose, and not to present a device that you are not entitled to submit.

Device Condition and Pre-existing State

Our services assess a device as it is presented. We record the condition we observe, including wear, dents, scuffs, panel damage, port condition and battery health. Those observations describe the state of the device at the time of the visit and are not a prediction of how the device will behave later.

A screening, a grade or a battery figure is a snapshot, not a guarantee of future performance. A device that passes a screening today may develop a fault tomorrow for reasons unrelated to anything we did. A panel grade reflects the display at the time of grading, and a battery figure reflects capacity at the time of measurement.

Where a device already has a fault at intake, we record it. Where a fault is intermittent, we describe what we observed and how often. We do not repair devices, and a report is not a repair estimate. Any decision to repair, resell, recycle or retire a device is yours to make.

Your Data and Backup Responsibility

You are responsible for your own data. Before leaving a device at the counter, you should back up anything you cannot afford to lose. Our standard services do not open private content and do not modify device storage, but no handling of a device is entirely without risk, and a device that is already failing may lose data for reasons that predate the visit.

We do not copy your personal content as part of a standard service. If you ask us to copy content so that a task can be completed, the copy is made only for that task, is deleted once the task is finished and the result has been given to you, and is never used for any other purpose. You confirm that you are entitled to have that content handled when you make such a request.

You should also make sure you can unlock the device, or can arrange any account access a requested step needs. A diagnostic that requires access cannot be completed without it, and we will record that the step was not run rather than guess at a result.

Data Wipe Verification Certificates

A data wipe verification certificate states that a device was cleared, identifies the device and records the date of verification. It is issued only after we have confirmed the wipe at the counter and checked that the device is in the expected cleared state.

A certificate is a record of what we verified at the time of the visit. It does not transfer ownership of a device, and it is not a statement about who is entitled to hold the device. It also does not warrant that no copy of any data exists elsewhere, such as on a remote backup or a cloud account that is outside the device itself. If you need that kind of assurance, you should address remote accounts directly.

A certificate may be reissued or confirmed later from our records where a partner or buyer asks. Because the certificate supports an auditable trail, the underlying record may be kept for a longer period than an ordinary screening slip, as described in our Privacy Policy.

Reports, Grades and Findings

Reports, grades and findings are professional assessments written at the bench. They are intended to give a clear, consistent picture of a device condition and performance. They are not legal advice, not a valuation, and not a guarantee that a third party will accept our assessment.

Panel grades range from A down to D and are assigned against the same touch grid and light pass every time. Battery figures are measured against the original rating and reported with the verdict they support. Condition notes describe what a technician observed. Where a reading is uncertain, we say so rather than overstate it.

A report belongs to the customer who requested it, and we will send it to the party that customer names. We will not alter the substance of a report to suit a later commercial disagreement. If a genuine transcription error is found, we will correct it and note the correction.

Business and Fleet Audit Terms

A fleet audit is arranged with the business that owns or manages the devices. The business provides the device list and the assignment mapping it wants recorded, and we return a structured report with a recommendation for each unit.

The business is responsible for delivering the devices to the counter, for telling its own staff how device assignment data is used, and for obtaining any consent the business relationship requires. We handle the audit information as confidential to the client and deliver the report only to the contact the client names.

Where an audit is large, we may schedule it as a project with agreed dates and a stated scope. Work outside that scope, such as additional devices added later, is treated as a new request unless the client and the counter agree otherwise in writing.

Fees and Payment

Fees for our services are quoted before work begins. A walk-in screening, a report or a certificate may carry a flat fee, while a fleet audit may be quoted per device or as a project. Any quote we give is valid for the period stated in it and may change if the scope of the work changes.

Payment is due at the time the service is completed or as otherwise agreed for a business client. Where a fee is not paid, we may decline to release a report, a certificate or a device until the matter is resolved. We do not operate as a debt collection service, and we do not add penalties beyond those the law allows.

If a service cannot be completed for a reason within our control, we will not charge for the part that was not delivered. If it cannot be completed for a reason within your control, such as a device that cannot be unlocked, we may charge for the time already spent. Any such charge is explained before it is applied.

Collection and Uncollected Devices

You agree to collect your device within the period told to you at intake. If you cannot collect it in person, you may arrange for someone else to collect it, provided that person presents the intake slip or another record we can match, and provided you have told us who is coming.

If a device is not collected within a reasonable period, we will try to reach you using the contact details on the intake slip. Where a device remains uncollected for an extended period despite those efforts, we may store it for a further limited time and then dispose of it or transfer it in a lawful manner. We will follow the law that applies to abandoned property in our area, and we will keep a record of what we did.

We are not responsible for a loss that results from a failure to collect a device or to keep contact details current.

No Warranty and Limitation of Liability

The website and our services are provided on an as-is basis. We do not warrant that the website will be uninterrupted or error free, and we do not warrant that a device will perform in any particular way after a screening, a grade or a battery check. Our reports describe what we observed, and nothing more.

To the fullest extent permitted by law, PeakScreen Mobile Testing LLC is not liable for indirect, incidental or consequential losses, including lost profits, lost data, lost opportunities or the cost of a replacement device, arising from the use of the website or the counter service. Where liability cannot be excluded, it is limited to the amount you paid for the specific service that gave rise to the claim.

Our standard services do not open private content and do not modify device storage. Where a loss relates to data that was already at risk before the visit, or to a device that was already failing, we are not responsible for that loss.

Indemnity

You agree to indemnify and hold harmless PeakScreen Mobile Testing LLC, its members and its team from any claim, loss or expense that arises from a device you submitted without the right to submit it, from information you provided that was inaccurate, or from a use of our services that breaks the law or breaches these terms.

If you act for a business, that business agrees to indemnify us for claims brought by its own staff or partners in connection with an audit we performed at the business request, to the extent the claim arises from the business instructions or from the business failure to give required notices.

This indemnity does not apply to the extent a claim results from our own negligence or our own breach of these terms.

Intellectual Property and Website Use

The website, its text, its layout and its visual design belong to PeakScreen Mobile Testing LLC and are protected by applicable law. You may view the website and use it for its intended purpose. You may not copy, republish or redistribute the content for commercial purposes without our written permission.

Test cards, grading scales and the structure of our reports are part of our method. A report we issue may be shared by the customer who requested it, including with a buyer, a business manager or a recycling partner, but the underlying method remains ours.

You may link to our pages freely. You may not frame our content in a way that suggests a relationship or endorsement that does not exist.

Prohibited Uses

You may not use the website or the counter service to submit a device you do not have the right to submit, to seek screening of a device that is stolen or the subject of a dispute, or to obtain a document through false information.

You may not attempt to interfere with the website, to gain unauthorised access to our records, or to use the contact form to send unlawful, abusive or deceptive content. You may not present another person device as your own in order to obtain a report that person has not authorised.

We may refuse service, stop work and take appropriate steps, including contacting the relevant authority, where we have a reasonable belief that a prohibited use has occurred or is about to occur.

Governing Law and Disputes

These terms are governed by the laws of the State of Utah in the United States, without regard to conflict of law rules. Any dispute that cannot be resolved by discussion will be handled in the courts that have jurisdiction over our location in Utah, unless the applicable law requires otherwise.

Before starting a formal claim, please raise the matter with us directly. Most concerns can be answered quickly from the record of the visit, and a review of the intake slip and the report usually settles the question. We ask that you give us a reasonable opportunity to respond before taking further steps.

If a dispute concerns a report we issued, we will preserve the related record while the matter is open so that the facts can be examined fairly.

Changes to These Terms

We may update these terms to reflect changes in our services or in the law. When we make a material change, we will update the date shown with the document and make the change visible on the website.

Continued use of the website or the counter service after an update means that you accept the revised terms. If you do not accept a revised version, you may stop using the service and ask us about the records that relate to a past visit. Terms in force at the time of a visit continue to govern that visit.

Contact Information

Questions about these terms and requests about a report or certificate are welcome. The quickest route is email, and the counter team also answers telephone inquiries during business hours.
